§ 3223. Eligible patients

Any person who meets the following requirements shall be eligible for the assistance of the Curable Catastrophic Illnesses Services Fund:

(a) Suffers a catastrophic illness, whose foreseeable effect is loss of life.

(b) That his/her physician certifies to being aware of the condition and that medical science has successfully proven that there is a treatment to remedy said condition to the extent of saving the patient’s life.

(c) That said treatment, including its diagnosis, is not covered or is only partially covered by the health insurance plans available in the general market, including the Government of Puerto Rico Health Insurance Plan.

(d) That the patient, the members of his/her family nucleus or those bound by law to support him/her, lack the financial resources to defray the expenses, and the means to acquire financing in private banking.

(e) That he/she has been domiciled in Puerto Rico for at least two (2) years prior to applying for assistance. In the event that the patient is under two (2) years of age, for the purpose of complying with this requirement, the time that his/her parents or legal guardians have resided in Puerto Rico shall be taken into consideration.

Those persons that, with the sole purpose of receiving medical treatment, have resided temporarily outside of Puerto Rico, and that due to their condition need to again move to receive medical treatment and do not have the financial resources to receive said treatment nor to cover the supplementary expenses associated thereto, are excepted from this provision.

(f) That he/she accepts and meets with the terms and conditions required by the Board and accepts to release the Board, its members and the Commonwealth of Puerto Rico from any liability for the results of the diagnosis or the treatment to be used.
