Section 2 AAC 90.450 - Reexamination requirements(a) If the department has good cause based on information received that a licensee is physically or mentally incompetent to operate a motor vehicle safely, or is otherwise not qualified to be licensed, the department may require the licensee to submit to a physical, mental, or driver's examination to determine the licensee's fitness to operate a motor vehicle safely. If the department determines from the results of an examination that the licensee is unfit to operate a motor vehicle safely, the department will either cancel the licensee's privileges to operate a motor vehicle in this state or issue the person a restricted license.(b) A licensee who suffers the permanent loss of a hand, arm, foot, leg, or eye must report to the department before operating a motor vehicle. The department may require a reexamination of the licensee's driving ability and restrict the licensee to the operation of a vehicle with special equipment.(c) The department may cancel a driver's license based on a request from a criminal justice agency, physician, or member of the general public. The department may require reexamination of a licensee. The request must state that the driver cannot safely operate a motor vehicle due to a physical or mental condition and explain the need for a reevaluation by providing specific information pertaining to the person's operation of a motor vehicle or physical condition. A request must be in writing, and may not be anonymous. A request will be treated with confidentiality if requested by the person submitting the request.(d) If the department is notified by means of a request under (c) of this section that a licensee may not be qualified to operate a motor vehicle safely, the department may cancel the driver's license or require the licensee to be reexamined. If the department requires a reexamination, the department will notify the licensee what examinations are necessary. The licensee may apply for a new driver's license or, if the license was not canceled, retain that person's license if the examinations are satisfactorily completed and passed.(e) The department may cancel or suspend the license of a person who refuses to submit to reexamination under this section.Eff. 7/1/2006, Register 178Authority:AS 28.05.011
