Section 76-8-317 - Refusal to comply with an order to evacuate or order issued in a local or state emergency(1) Terms defined in Sections 76-1-101.5 and 76-8-101 apply to this section.(2) An actor commits refusal to comply with an order to evacuate or order issued in a local or state emergency if the actor:(a) receives notice of: (i) an order to evacuate issued under Title 53, Chapter 2a, Emergency Management Act; or(ii) an order issued: (A) by the governor in a state of an emergency under Section 53-2a-204; or(B) by a chief executive officer in a local emergency under Section 53-2a-205; and(b) refuses to comply with the order described in Subsection (2)(a).(3) A violation of Subsection (2) is a class B misdemeanor.Amended by Chapter 96, 2024 General Session ,§ 64, eff. 5/1/2024.Amended by Chapter 295, 2013 General Session ,§ 99, eff. 5/14/2013.Amended by Chapter 370, 2010 General Session
