(a) A person may not use an automated dial announcing device without a permit issued by the commission.(b) An applicant for an original permit must submit to the commission an application on a form that: (1) is prescribed by the commission; and(2) contains: (A) the telephone number of each automated dial announcing device that the person will use; and(B) the physical address from which each automated dial announcing device will operate.(c) An original permit is valid for one year and may be renewed annually by filing with the commission the information required by Subsection (b)(2).(d) An application for an original permit or a filing required for the renewal of the permit must be accompanied by the appropriate fee prescribed by Section 55.131.(e) In determining whether to deny an application for an original permit or renewal of the permit, the commission shall consider the compliance record of the owner or operator of the automated dial announcing device and may deny the application based on that record.
