Section 2155.139 - Exemption for Certain Libraries and Health Facilities(a) Section 2155.061 does not apply to an acquisition if: (1) the acquisition is for a: (A) library operated as a part of a university system or institution of higher education;(B) library or resource-sharing program operated by the Texas State Library and Archives Commission; or(C) state-owned hospital or clinic; and(2) the goods or services acquired are:(A) serial and journal subscriptions, including electronic databases and information products;(B) library materials, including books not available under a statewide contract and papers;(C) library services, including binding services not available under a statewide contract; or(D) library equipment and supplies.(b) Section 2155.061 does not apply to a purchase of goods by a state-owned hospital or clinic through a group purchasing program that offers purchasing services at discount prices to two or more hospital or clinic facilities if the chief executive officer of the hospital or clinic or the officer's designee certifies that the purchase of the particular goods through the group purchasing program is the most cost-effective method of purchasing available.Tex.
