Section 61.026 - Committees And Advisory Committees(a) The chair may appoint committees from the board's membership as the chair or the board considers necessary . (b)[As amended by Acts 2013, 83rd Leg. - Regular Session, ch. 983,Sec. 2] If the board directs an advisory committee to assist the board in exercising its authority under Section 61.051(j) regarding an off-campus course in nursing education, including clinical coursework, the board shall require the advisory committee to include or consult with one or more private postsecondary educational institutions or private career schools and colleges in this state that offer degree programs. (b) [As amended by Acts 2013, 83rd Leg. - Regular Session, ch. 1155,Sec. 28] The board may appoint advisory committees from outside its membership as the board considers necessary. Chapter 2110, Government Code, applies to an advisory committee appointed by the chair or the board. The board shall adopt rules, in compliance with Chapter 2110, Government Code, regarding an advisory committee that primarily functions to advise the board, including rules governing an advisory committee's purpose, tasks, reporting requirements, and abolishment date. A board member may not serve on a board advisory committee. (c) The board may adopt rules under this section regarding an advisory committee's: (1) size and quorum requirements; (2) qualifications for membership, including experience requirements and geographic representation; (3) appointment procedures; (4) terms of service; and (5) compliance with the requirements for open meetings under Chapter 551, Government Code. (d) Each advisory committee must report its recommendations directly to the board.
