Section 38.006 - E-Cigarettes and Tobacco Products on School Property(a) In this section, "e-cigarette" has the meaning assigned by Section 161.081, Health and Safety Code.(b) The board of trustees of a school district shall:(1) prohibit smoking or using e-cigarettes or tobacco products at a school-related or school-sanctioned activity on or off school property;(2) prohibit students from possessing e-cigarettes or tobacco products at a school-related or school-sanctioned activity on or off school property; and(3) ensure that school personnel enforce the policies on school property.Amended by Acts 2015, Texas Acts of the 84th Leg. - Regular Session, ch. 181,Sec. 38, eff. 10/1/2015.Added by Acts 1995, 74th Leg., ch. 260, Sec. 1, eff. 5/30/1995.
