Section 47-25-109 - Giving away or underpricing goods prohibited - Samples excepted(a) It is unlawful for any person engaged in the business of manufacturing in this or any other state to give away or sell for a less price than the cost of manufacture, any manufactured article in this state, with the intent and purpose of destroying honest competition; provided, that nothing in this section shall be construed to prohibit the distribution to consumers of specimens of proprietary articles in good faith as samples.(b) Any person violating this section commits a Class C misdemeanor.Acts 1907, ch. 36, §§ 1, 2; 1907, ch. 360, § 1; Shan., §§ 3191a3, 3191a4; Code 1932, §§ 5889, 5890; T.C.A.
