Section 690-234 - Auxiliary blowers and fans(a) Procedure.--(1) The operator of a mine who desires to use in the mine an auxiliary blower or exhaust fan shall submit to the department a ventilation plan showing the proposed use of the auxiliary blower or exhaust fan.(2) The department shall review the plan and take one of the following actions: (ii) Request additional information.(iii) Disapprove the plan and set forth in writing its reasons for the disapproval.(3) In approving a plan, the department shall require that an auxiliary blower or exhaust fan shall be: (i) Powered by an approved motor when installed underground.(ii) Operated continuously while any work is being performed in the area being ventilated by the blower or fan.(iii) Be so placed that recirculation of the air is not possible.(b) Time period for review.--The department shall approve or disapprove a plan within 60 days after being initially submitted by the operator.2008, July 7, P.L. 654, No. 55, §234, effective in 180 days [ 1/5/2009].
