Section 407 - Officers to secure funds, records, books, et cetera, from predecessors(a) Any person, elected or appointed, and duly commissioned to any county office, shall demand and receive all records, books, drafts, plans, papers, seals or other official things, including all public funds held in the office, and not otherwise provided for by Article XIII.1 of the act of April 9, 1929 ( P.L. 343, No.176), known as "The Fiscal Code," belonging to the office from the person or persons who held the office immediately before the officer's election or appointment, or from any other person or persons holding or possessing them.(b) Any person detaining from such a county office any records, books, drafts, plans, papers, seals or other official things, including public funds, as herein provided, belonging to an office after reasonable demand has been made, shall be guilty of a misdemeanor, and, upon conviction thereof, shall be sentenced to undergo imprisonment until the delivery of any such official things found to be in the person's possession or control to the proper officer, or until sooner discharged by order of the court, and to pay a fine not exceeding five hundred dollars ($500), to be paid to the use of the county.
