Section 638.145 - Evidentiary standard for refusing to issue license or taking disciplinary action1. The Board shall not refuse to issue a license to an applicant or take any disciplinary action against a licensee unless the Board finds, by a preponderance of the evidence, that the applicant or licensee has engaged in one or more of the practices prohibited by the provisions of this chapter.2.
