Section 375.251 - Actions by and against companies1. Civil actions may be maintained by any insurance corporation formed under the laws of this state against any of its members or stockholders, for any cause relating to the business of the company.2. Civil actions may also be prosecuted and maintained by any member or stockholder of the corporation against the corporation for loss which may have accrued in favor of any member or stockholder on any risk or policy, if payment is withheld for more than two months after the loss shall have become due; but no action shall be brought or maintained by any person other than the director of the department of commerce and insurance of this state for the winding up or dissolution of any insurance company, or the distribution of its assets among its creditors.RSMo 1939 § 6023, A.L. 1967 p. 516
