Section 33:4876.4 - Notice; time frame
A. The procedures for the abatement and removal of a public nuisance under R.S. 33:4876.3 shall provide not less than ten days notice of the nature of the nuisance. The notice must be personally delivered, sent by certified mail with a five-day return requested, or delivered by the United States Postal Service with signature confirmation service to:
(1) The last known registered owner of the public nuisance vehicle.
(2) Each lienholder of record of the public nuisance vehicle.
(3) The owner or occupant of:
(a) The property on which the public nuisance vehicle is located.
(b) The property adjacent to the right-of-way, if the public nuisance vehicle is located in a public right-of-way.
B. The notice shall clearly state the following:
(1) The public nuisance vehicle must be abated and removed not later than the tenth day after the date on which the notice was personally delivered or mailed.
(2) Any request for a hearing must be made within ten days.
C. If the post office address of the last known registered owner is unknown, notice may be placed on the public nuisance vehicle or, if the owner is located, personally delivered.
D. If the notice is returned, undelivered, action to abate the public nuisance vehicle shall be continued to a date not earlier than the eleventh day after the date of the return.
E. Notwithstanding any provision of law to the contrary, the provisions of this Section shall not be applicable in any parish with a population between four hundred and twenty thousand persons and four hundred and thirty thousand persons based on the latest federal decennial census.
