Noncompliance with the obligation to deposit the sum owed for any reason to his former employees by the employer pursuant to § 1 of this title with the Secretary of Labor and Human Resources shall constitute a misdemeanor crime and, upon conviction, shall be punished with a fine of not less than one hundred dollars ($100) nor more than five hundred dollars ($500), or imprisonment for a term of not less than thirty (30) days nor more than ninety (90) days, or both penalties, at the court’s discretion.
