§ 3074. Faculties of the Office of the Healthcare Advocate and the Insurance Commissioner

The Office of the Healthcare Advocate and the Insurance Commissioner are hereby empowered to:

(a) Act on complaints related to noncompliance with the provisions of this chapter.

(b) Carry out detailed investigations on the grounds and circumstances resulting in, without it being limited to, services that agencies are not rendering, discriminatory and hostile conduct or language, the interruption or cut of health insurance benefits, marginalization, malpractice, deceptive advertising, misrepresentation, and dismissal or hostile work environment, so that the necessary measures shall then be taken to guarantee the rights of the people affected.

(c) Refer cases to the Department of Justice.

(d) If any cancer patient or survivor believes that his/her claim has not been satisfactorily addressed, he/she, his/her guardian, or a public official or particular person interested in his/her wellbeing may resort to the Office of the Ombudsman, the Department of Labor, and/or the Office of the Insurance Commissioner to file a complaint related to any noncompliance with this chapter, which shall be investigated and, if necessary, referred to the Department of Justice.
