Any public officer, employee, former officer or former employee who uses for his/her own benefit or for the benefit of a third party any information or data that could have been known solely by reason of his/her office, employment or assignment shall incur a fourth degree felony.
If the person obtains the pursued benefit, he/she shall incur a third degree felony.
The court may also impose restitution.
