If the estate charged with an annuity is to be awarded to several heirs, and the annuitant does not give his consent to the division, it shall be placed at auction among the heirs.
In the absence of agreement or if none of the parties in interest should offer the price of the appraisement, the estate shall be sold with the charge, the proceeds being distributed among the heirs.
