Section 36-7-4-909 - Board of zoning appeals; members; conflict of interest; disqualification(a) A member of a board of zoning appeals is disqualified and may not participate in a hearing or decision of that board concerning a zoning matter if the member:(1) is biased or prejudiced or otherwise unable to be impartial; or(2) has a direct or indirect financial interest in the outcome of the hearing or the decision.(b) The board shall enter in the board's records:(1) the fact that a regular member has such a disqualification; and(2) the name of the alternate member, if any, who participates in the hearing or decision in place of the regular member.Pre-Local Government Recodification Citations: 18-7-4-909; 18-7-5-1 part.
