Section 20-33-2-17 - [Effective 7/1/2024] Attendance exception; duty with Indiana National Guard

The governing body of a school corporation, the organizer of a charter school, or the chief administrative officer of a nonpublic school system shall authorize the absence and excuse of each secondary school student who is:

(1) not a habitual truant (as defined in IC 20-18-2-6.5); and
(2) ordered to active duty with the armed forces of the United States, including their reserve components, or the Indiana National Guard for at least fifteen (15) days in a school year.

However, the governing body of a school corporation, the organizer of a charter school, or the chief administrative officer of a nonpublic school system may authorize additional excused absences for additional military training. For verification, the student must submit to school authorities a copy of the orders to active duty and a copy of the orders releasing the student from active duty. A student excused from school attendance under this section may not be recorded as being absent on any date for which the excuse is operative and may not be penalized by the school in any manner.
