Section 720 ILCS 570/209 - [Effective 1/1/2025] The Department, taking into consideration the recommendations of its Prescription Monitoring Program Advisory Committee, may issue a rule scheduling a substance in Schedule IV if it finds that:
(1) the substance has a low potential for misuse relative to substances in Schedule III;(2) the substance has currently accepted medical use in treatment in the United States; and(3) misuse of the substance may lead to limited physiological dependence or psychological dependence relative to the substances in Schedule III.Amended by P.A. 103-0881,§ 20, eff. 1/1/2025.Amended by P.A. 097-0334,§ 5, eff. 1/1/2012.This section is set out more than once due to postponed, multiple, or conflicting amendments.
