Section 42-61-6 - Proceeds of sales - Segregated funds(a) All proceeds from the sale of lottery tickets or shares received by a person in the capacity of a sales agent shall constitute a trust fund until paid into the state lottery fund.(b) The sales agent shall be personally liable for all proceeds; and failure to pay the lottery division moneys owed, upon demand, from the sales or misappropriation of the funds shall constitute embezzlement under § 11-41-3.(c) The provisions of this section shall be enforced and prosecuted by the state police and the attorney general's office.P.L. 1984, ch. 180, §2; P.L. 2005 , ch. 234, § 1; P.L. 2005 , ch. 236, § 1.
