Section 79 - Leasing of state institutions to cities or counties for the confinement of prisoners1. The commissioner is hereby authorized and empowered to lease to any city or county, upon such terms and conditions as he may deem appropriate, all or any part of any state correctional institution or facility under his jurisdiction, to be used as an adjunct to a jail, penitentiary or correctional institution of such city or county, for the confinement of persons sentenced to such jail, penitentiary, or correctional institution. Such lease may provide for the commissioner to have the superintendence, management and control of the state correctional institution or facility, or part thereof, which is the subject of such lease. Such lease shall provide for such city or county to pay to the state the actual per capita daily cost, as certified to the appropriate local official by the commissioner, for the care of such persons for each day of confinement, but, in any case, the reimbursement rate shall not exceed five dollars per day per capita.
