Section 25-48-120 - Safe disposal of unused medical aid-in-dying medicationsA person who has custody or control of medical aid-in-dying medication dispensed under this article that the terminally ill individual decides not to use or that remains unused after the terminally ill individual's death shall dispose of the unused medical aid-in- dying medication either by:
(1) A person who has custody or control of medical aid-in-dying medication dispensed under this article 48 after a terminally ill individual's death shall dispose of the unused medical aid-in-dying medication either by:(a) Returning the unused medical aid-in-dying medication to the attending provider who prescribed the medical aid-in-dying medication, who shall dispose of the unused medical aid-in-dying medication in the manner required by law; or(b) Lawful means in accordance with section 25-15-328, or any other state or federally approved medication take-back program authorized under the federal "Secure and Responsible Drug Disposal Act of 2010", Pub.L. 111-273, and regulations adopted pursuant to the federal act.(2) Lawful means in accordance with section 25-15-328, C.R.S. or any other state or federally approved medication take-back program authorized under the federal "Secure and Responsible Drug Disposal Act of 2010", Pub.L. 111-273, and regulations adopted pursuant to the federal act.Amended by 2024 Ch. 406,§ 15, eff. 8/7/2024.Initiated 2016: Entire article added, Proposition 106, L. 2017, p. 2813, §1, effective upon proclamation of the Governor, December 16, 2016.2024 Ch. 406, was passed without a safety clause.
