Section 12-245-409 - Employees of social services(1) Notwithstanding the exemption in section 12-245-217 (2)(b), an employee of the department of human services or the behavioral health administration in the department of human services, an employee of a county department of human or social services, or personnel under the direct control or supervision of those departments or administration shall not state that the person is engaged in the practice of social work as a social worker or refer to the person's self as a social worker unless the person is licensed pursuant to this part 4 or has completed an earned social work degree, as specified in section 12-245-401 (9).(2) Notwithstanding the exemption in section 12-245-217 (2)(b), any employee licensed pursuant to this article 245 who is terminated from employment by the department of human services, the behavioral health administration in the department of human services, or a county department of human or social services is subject to review and disciplinary action by the board that licenses or regulates the employee.(3) An employee of the department of human services, the behavioral health administration in the department of human services, or a county department of human or social services who has completed a bachelor's or master's degree in social work may apply to the board, for purposes related to licensure under this part 4, for approval for supervision by a person other than a licensed clinical social worker.
