Section 13-21A-02 - State Brain Injury Trust Fund
(a) There is a State Brain Injury Trust Fund.
(b)
(1) The purpose of the Fund is to assist in the provision of the following services to eligible individuals who have sustained brain injuries:
(i) Individual case management services; and
(ii) Neuropsychological evaluation.
(2) The Fund may be used to support:
(i) Prevention, education, and awareness programs;
(ii) Rehabilitation services;
(iii) Medical services;
(iv) Durable medical equipment;
(v) Assistive technology assessment and equipment;
(vi) Services to assist in the return to driving;
(vii) Evaluation and training related to the brain injury;
(viii) Neurobehavioral health services;
(ix) Nursing home transition services;
(x) Community reentry services;
(xi) Educational needs;
(xii) Housing and residential services; and
(xiii) Transportation services.
(c) The Secretary or the Secretary's designee shall administer the Fund.
(d)
(1) The Fund is a special, nonlapsing fund that is not subject to § 7-302 of the State Finance and Procurement Article.
(2) The State Treasurer shall hold the Fund separately, and the Comptroller shall account for the Fund.
(e) The Fund consists of:
(1) Money appropriated in the State budget to the Fund;
(2) Investment earnings of the Fund; and
(3) Any other money from any other source accepted for the benefit of the Fund.
(f) The Fund may be used only to provide funding for the purpose described in subsection (b) of this section.
(g)
(1) The State Treasurer shall invest the money of the Fund in the same manner as other State money may be invested.
(2) Any investment earnings of the Fund shall be credited to the Fund.
(h) Money expended from the Fund to support services to individuals with brain injuries is supplemental to and is not intended to take the place of funding that would otherwise be appropriated for those services.
