Section 41-16-53 - Letting of contracts without public advertisement authorized in case of emergencies affecting public health, safety, etc

Notwithstanding any law to the contrary, in the event circumstances arise for which a delay in remedying or otherwise addressing would likely cause harm to an individual or public property, a contract may be let to the extent necessary to mitigate the harm without regard to the requirements of this article, provided the awarding authority does both of the following:

(1) Documents two or more price quotations or price estimates before letting the contract.
(2) Adopts a resolution declaring the nature of the circumstances, the action to be taken, and the reasons for taking the action.
