Section 6-41-206 - Responsibilities of state and school districts(a)(1) The responsibility of school districts and the state to provide free public education for children with disabilities is not diminished by the availability of private schools and services.(2) Whenever private schools and services are utilized, it continues to be the responsibility of the appropriate local school district and the State Board of Education to assure an appropriate quantity and quality of instructional and related services, to assure the protection of all other rights, and to ascertain that all children with disabilities receive the educational and related services and rights to which the law of this state entitles them.(b) It shall be the responsibility of the local school district and the state to provide a free and appropriate public education based upon the individualized education program developed for the child.Acts 1973, No. 102, § 9; 1975, No. 641, § 3; A.S.A. 1947, § 80-2123; Acts 1989, No. 703, §§ 2, 3; 1993, No. 294, § 14; 1999, No. 391, § 26; 2007, No. 1573, § 37.
