Section 23-16-510 - Penalties(a)(1) A person who knowingly violates a provision of this subchapter is liable to the state for a civil penalty not to exceed one thousand dollars ($1,000) for each violation.(2) Each day that a violation continues is a separate offense.(b) The Arkansas Highway Police Division of the Arkansas Department of Transportation shall assess penalties for violations under this subchapter by written notice to the violator.(c) To determine the amount of the penalty, the Arkansas Department of Transportation or its designee shall evaluate: (1) The nature, circumstances, extent, and gravity of the violation;(2) The degree of culpability, history of prior offenses, ability to pay, and effect on the ability to continue to do business of the person found to have committed a violation; and(3) Other circumstances as justice may require.Amended by Act 2017, No. 707,§ 264, eff. 8/1/2017.
