Section 173-400-081 - Emission limits during startup and shutdown(1) In promulgating technology-based emission standards and establishing emission limits in a permit or order the permitting authority will consider any physical constraints on the ability of a source to comply with the applicable standard during startup or shutdown.(2) When the permitting authority determines, as part of its control technology determination, that the source or source category, when operated and maintained in accordance with good air pollution control practice, is not capable of achieving continuous compliance with an emission limit or standard during startup or shutdown, the permitting authority must include in the rule, order, or permit appropriate alternative emission limitations to regulate the performance of the source during startup or shutdown conditions.(3) In modeling the emissions of a source for purposes of demonstrating attainment or maintenance of national ambient air quality standards, the permitting authority shall take into account any incremental increase in allowable emissions under startup or shutdown conditions authorized by an emission limitation or other operating parameter adopted under this rule.(4) An emission limitation or other parameter adopted under this section which increases allowable emissions during a startup or shutdown event over levels authorized in Washington's SIP shall not take effect until: (a) Approved by EPA as a SIP amendment; and(b) The permitting authority has complied with WAC 173-400-082(4)(c)(i)(A) and (B) and (iv) when applicable.Wash.
