Section R994-405-407 - Grade, Group or Class of Worker(1) A claimant is a member of the grade, group or class if: (a) the dispute affects hours, wages, or working conditions of the claimant, even if the claimant is not a member of the group conducting the strike or not in sympathy with its purposes,(b) the labor dispute concerns all of the employees and as a direct result causes a stoppage of their work,(c) the claimant is covered either by the bargaining unit or is a member of the union, or(d) the claimant voluntarily refuses to cross a peaceful picket line even when the picket line is being maintained by another group of workers.(2) A claimant is not included in the grade, group or class if: (a) the claimant is not participating in, financing, or directly interested in the dispute or is not included in any way in the group that is participating in or directly interested in the dispute,(b) the claimant was an employee of a company that has no work for him or her as a result of the strike, but the company is not the subject of the strike and whose employee's wages, hours or working conditions are not the subject of negotiation,(c) the claimant was an employee of a company that is out of work as a result of a strike at one of its work sites but he or she is not participating in the strike, will not benefit from the strike, and the constitution of the union leaves the power to join a strike with the local union, provided the governing union has not concluded that a general strike is necessary, or(d) work continues to be available after a strike begins and the claimant reported for work and performed work after the strike began and was subsequently unemployed.(3) The burden of proof is on the claimant to show that he or she is not participating in any way in the strike.Utah Admin.
