Section 0250-07-09-.05 - WHEN RIGHTS UNDER THIS CHAPTER ATTACH(1) An individual whom the Department has classified in a substantiated report as a perpetrator of any form of abuse or neglect shall have the right to request a formal file review.(2) If at the conclusion of the formal file review the substantiation is upheld, with or without modification, the individual shall have the right to request an administrative hearing. An individual who fails to request a formal file review after proper notice waives their right to an administrative hearing.Tenn. Comp. R. & Regs. 0250-07-09-.05
