The fair hearing will be conducted by the Department's Office of Hearings and Appeals in conformance with the Department's Office of Hearings and Appeals' procedures. The institutional collections officer completing the liability assessment shall participate in the hearing to explain how the assessment was completed. The Department staff member responsible for reviewing the request for abatement or modification or both shall participate in the hearing process.
