Section 605:10-11-1 - Acts of associates
(a)Requirement. All acts performed by an associate under the provisions of the "Real Estate License Code" shall be done only in the name of the associate's broker.
(b)Limitation. An associate shall not be allowed to work for more than one broker at the same time.
(1) An exception to this subsection would be if the associate's broker agreed to loan the associate to another broker for a specific duty to be performed, such as:
(A) Sitting at an open house.
(B) Calling an auction or performing other auction related duties.
(C) Any other specific duty as requested in writing and approved by the Commission.
(2) The broker is responsible for all acts performed by the associate while the associate is performing a specific duty for another broker.
(c)An associate is responsible for acts of unlicensed assistants. An associate who employs an unlicensed assistant is responsible in conjunction with the broker for all real estate related activities of the unlicensed assistant.
