Section 43-02-02.4-38 - Line markers for brine pipelinesIf a pipeline conveys liquids to or from a well located outside the perimeter of a manufacturing plant, it is subject to the provisions of this section.
1. Except as provided in subsection 2, a marker shall be placed and maintained as close as practicable over each buried brine pipeline, as follows: a. At each crossing of a public road and railroad.b. When necessary to identify the location of the brine pipeline to reduce the possibility of damage or interference.c. At the point of crossing of or under waterways and other bodies of water.2. Markers shall be placed and maintained along each section of a brine pipeline that is located aboveground in an area which is accessible to the public.3. The following information shall be written legibly on a background of sharply contrasting color on each brine pipeline marker:a. The word "warning", or "caution", followed by the words "waste product brine" or "brine pipeline", all of which, except for markers in heavily developed urban areas, shall be not less than one and one-half inches high and legible under normal conditions at a distance of twenty-five feet.b. The name of the operator and the telephone number, including the area code, where the operator can be reached at all times.N.D. Admin Code 43-02-02.4-38
