Section 145-6.2 - Regents physicians loan forgiveness program

(a) Eligibility. Residents of New York State, or students who meet the requirements set forth in subparagraph (ii) of paragraph a or subparagraph (ii) of paragraph b of subdivision five of section 661 of the Education Law, as applicable, who are licensed to practice medicine, and who have completed a professional residency program within the time specified by Education Law section 605 (9)(a)(2), or are within two years of completion of an accredited residency program in a primary care specialty designated in short supply by the Board of Regents, and who agree to practice medicine in an area of shortage of physicians, shall be eligible for an award pursuant to this section and subdivision (9) of section 605 of the Education Law.

(1) For the purposes of this subdivision, licensed to practice medicine shall mean licensed to practice medicine in the State of New York.

(2) Professional or accredited residency program. For the purposes of this subdivision, a professional or accredited residency program shall mean a postgraduate professional training program approved by the Accreditation Council for Graduate Medical Education or the American Osteopathic Association.

(b) Areas of shortage of physicians. For the purposes of this program, the Board of Regents, after consultation with the Commissioners of Health, Correctional Services, Mental Health and Mental Retardation and Developmental Disabilities, shall establish relative rankings of areas of shortage of physicians in order of the severity of the shortage.

(c) Criteria in selection of award recipients. An applicant must satisfy at least one of the criteria established by Education Law, section 605(9)(b) to be selected as an award recipient. A priority shall be accorded to any applicant who is completing the second year of the service requirement and is reapplying for a new award.

(d) Commencement of service requirement. An award recipient shall begin the service requirement within six months from the date upon which that individual is notified of an entitlement to an award, except when an award is made to an individual while in an accredited residency program, pursuant to Education Law section 605(9)(a)(2), in which case the award recipient shall begin the service requirement within three months of completing such residency program.
