(a) The respondent and the superintendent shall appear for hearing before the Banking Board at the place and time fixed in the notice of hearing.(b) If it shall appear at the hearing that there are material disputed issues of fact, or if the superintendent or respondent requests oral testimony, or if the Banking Board for any reason desires oral testimony, the Banking Board shall direct that sworn evidence be taken, either before itself or before a hearing officer designated by the Banking Board.N.Y.
