Section 407.11 - Waivers
(a) Upon receipt of a written request from a social services district, the department may issue a written waiver of any provision of this Part. Any request for a waiver must include:
(1) the specific regulation(s) for which a waiver is sought;
(2) a statement indicating how granting the waiver will enhance or simplify the planning process;
(3) a proposal describing, to the satisfaction of the department, what the social services district intends to do to achieve or maintain the intended purpose of the regulation(s) if a waiver is granted; and
(4) any other information the department may deem necessary to determine whether a waiver should be granted.
(b) Waivers granted pursuant to this section will be based upon the department's review of the information submitted pursuant to this section, and may be limited in duration and scope at the discretion of the department.
(c) Failure to adhere to the terms of the waiver will result in the recision of the waiver.
(d) The department will maintain a record of any waiver issued under this section, a list of any regulations waived, and the reasons why each such waiver was issued.
