Section 380-2.3 - Leave for qualifying exigency arising from the service of a family member in the armed forces of the United States
(a) Family leave benefits for an eligible employee that are based upon a qualifying exigency as interpreted under the Family and Medical Leave Act, 29 U.S.C.S 2612(a)(1)(e) and 29 C.F.R. 825.126(b)(1)-(9), arising out of the fact that the spouse, domestic partner, child, or parent of the employee is on active duty (or has been notified of an impending call or order to active duty) in the armed forces of the United States, shall be paid for no longer than the maximum periods of time as set out in section 204 of the Workers' Compensation Law.
(b) A claim for such benefits shall be made and processed in the same manner as other claims for family leave benefits.
