Section 8:59-1.4 - Covered employers exempt from provisions of the law(a) Any public employer that transmits to the Department a Right to Know survey, which indicates that no hazardous substances are present at the facility, shall be exempt from the provisions of the Act for that facility, except for the requirement to annually update the Right to Know Survey pursuant to 8:59-2, and except for the provisions of 34:5A-33 and 8:59-8 providing enforcement of violations of the Act. Any residential dwelling that meets this condition, including those located in State, county, and local parks, shall be exempt from meeting the requirement of 8:59-2.(b) Any public employer exempted from the provisions of the Act pursuant to this section that transmits to the Department an update of the Right to Know Survey, which indicates that a hazardous substance is present at the public employer's facility, immediately shall be subject to all the provisions of the Act.N.J.
