Section 7:9A-12.2 - System maintenance
(a) The individual subsurface sewage disposal system shall be maintained in accordance with this chapter, the system approval issued by the administrative authority, and any applicable mandatory maintenance program including, but not limited to, any applicable ordinance adopted in accordance with 7:9A-3.1 or 7:15-5.25(e), by the system owner, or a qualified professional retained by the system owner in order to prevent the system from malfunctioning and/or becoming non-compliant as defined in 7:9A-3.4.
(b) Maintenance activities shall include, but not be limited to, inspection of the septic tank or other pre-treatment units, the distribution box and connecting pipes, and the disposal field as well as scheduled pump-outs of the septic tank. Maintenance activities shall be conducted in a manner consistent with this chapter, the approval issued by the local administrative authority and any applicable mandatory maintenance program as described in (a) above. Upon detection, all potentially non-compliant systems shall be reported to the administrative authority in accordance with 7:9A-3.4. Septic effluent filters shall be maintained in such a way to prevent solids, scum, or floatables from entering the effluent distribution network and disposal field.
(c) The Department recommends the use of the applicable sections of the inspection protocol established in 7:9A-12.6 for inspecting any portion of a system during maintenance activities.
(d) Systems approved by a treatment works approval shall be maintained in accordance with conditions specified in that approval.
(e) Any system not maintained in accordance with this section shall be deemed non-compliant in accordance with 7:9A-3.4.
