Section 5:42-2.9 - Live-in aide(a) A participant or applicant may request that the DCA approve a live-in aide to reside in the unit and provide necessary supportive services for a household member who is a person with a disability.(b) The DCA shall approve a live-in aide if needed as a reasonable accommodation in accordance with 24 CFR Part 8 in order to make the program accessible to and usable by the household member with a disability. 1. The DCA shall determine the need for a live-in aide upon review and approval of a Certification of Need for Live-In Aide form submitted by the applicant or participant and completed by a physician specifying the number of days per week and the number of hours per day that the live-in aide must provide necessary supportive services.2. The DCA will not approve a request for a live-in aide where the live-in aide was a member of the household prior to the household's request to approve the live-in aide.(c) The income of a DCA-approved live-in aide will be excluded from the annual income of the assisted household.N.J.
