1. Any interested person may submit to the State Forester a petition to nominate a species of native flora for inclusion on the list of fully protected species of native flora. A petition must be submitted on a form provided by the Division and must include, with specific references or citations, as applicable:(a) The name, mailing address and organization or affiliation, if any, of the petitioner;(b) The signature of the petitioner and the date the petition was signed;(c) A statement of the reasons for the proposed nomination, which must include, without limitation: (1) The location and habitat of the proposed species of native flora;(2) The current status of the species of native flora and its habitat;(3) Any changes in threats to the species of native flora, extinction potential of the species of native flora, protections afforded to the species of native flora and conservation of the species of native flora, including, without limitation, the associated timelines of such threats, extinction potential, protections and conservation;(4) Any changes in the factors that threaten the survival of the species of native flora, including, without limitation, overexploitation and disease;(5) Any changes in the habitat of the species of native flora, including, without limitation, threatened destruction or drastic modification to the habitat or severe curtailment of the habitat; and(6) Any other known scientific information or data on the species of native flora;(d) An estimate of all known directly adverse and beneficial economic effects of the proposed nomination;(e) A statement concerning the jurisdiction and laws of federal, state and local governmental agencies that overlap or duplicate the proposed nomination, including, without limitation, specific references to any such jurisdiction or laws; and(f) Any other relevant data or information.2. Not later than 90 days after a petition to nominate a species of native flora is submitted to the State Forester pursuant to subsection 1, the State Forester will:(a) Notify the petitioner in writing of his or her decision to deny the petition, including the reasons for the denial; or(b) Initiate the process to include the species on the fully protected list of native flora.Nev.
