The hearing officer shall receive all evidence in accordance with the criteria set forth in Neb. Rev. Stat § 84-914. Ex-parte communications shall be strictly limited to procedural matters not involving the factual basis of any claim. Transfer of agency documents to the Appeal Tribunal and the submission of proposed exhibits to be offered into evidence at a hearing conducted by telephone conference call shall not be considered an ex-parte communication.
