Part 5510.0710 - CERTIFICATION, REPRESENTATION, AND DECERTIFICATION PETITIONSSubpart 1.Filing petition.A petition for certification, representation, or decertification must include:
A. the name, address, e-mail address, and telephone number of all other employee organizations or exclusive representatives known to have an interest in or claiming to represent any of the employees involved;B. a statement on whether there is an effective labor contract and the contracts expiration date; C. the type of public employer involved;D. the approximate number of employees included in the proposed or previously determined appropriate unit;E. the proposed or previously determined appropriate unit description;F. a statement indicating that at least 30 percent of the employees in the proposed or previously determined unit support the intent of the petition;G. the date the petition is signed; andH. the name and title of the person signing the petition.Subp. 2.Showing of interest.A. Evidence of a showing of interest in the form of authorization signatures must accompany all petitions. An adequate showing of interest necessary to conduct an investigation or hearing is constituted by authorization signatures from 30 percent or more of the estimated number of employees in the established or proposed appropriate unit.B. Evidence of a showing of interest may continue to be submitted until the hearing closes.Subp. 3.Employer-provided information.A. An employer must provide to the exclusive representative the name, home mailing address, and telephone number for all employees in the established appropriate unit if: (1) the information is requested by the exclusive representative; or(2) the commissioner orders the employer to release the information.B. A request or order under this subpart must be consistent with Minnesota Statutes, section 13.43, subdivision 6.Minn.
