Section 26.01.02.39 - Appeal
A. Each party is required to exhaust its administrative remedies as a precondition to appealing any issue in a final decision. This exhaustion requirement includes the exceptions process under Regulation .35, which is available when the hearing examiner is not the final decision maker.
B. Within 10 days of filing an appeal, the appealing party shall file with the Office of Hearings a request to transmit the record to the appropriate court.
