Section 10.52.08.03 - Maryland AIDS Drug Assistance Program FundA. The Maryland AIDS Drug Assistance Program Fund is a nonlapsing, special fund created by Health-General Article, §24-1801, Annotated Code of Maryland, for HIV treatment and care, which is generated from: (1) The 340B Drug Pricing Program and any supplemental rebate dollars; and(2) Interest earned on the balance of the Fund.B. The Department may only expend funds in accordance with Title 26 of the Public Health Service Act governing the allowable uses of RWHAP funds or to meet State-identified HIV priorities.C. The Department may make grant awards under the Fund.D. Any unspent portions of the Fund shall remain in the Fund and may not revert to the General Fund of the State.E. Money expended from the Fund is additive to, and is not intended to take the place of, funding that would otherwise be appropriated to the Department for HIV: Md. Code Regs. 10.52.08.03
