Section 10.01.13.06 - Department Action on Application for Waiver
A. The Secretary may grant a waiver of provisions of the applicable licensing regulation if the:
(1) Applicant has filed a written request for a waiver in accordance with Regulation .05 of this chapter;
(2) Waiver is not inconsistent with the purposes and provisions of the statute under which the regulations are promulgated, and the health, safety, and well-being of the children in the facility will not be jeopardized solely by the granting of the waiver; and
(3) Applicant has demonstrated the facts required in Regulation .05B(3) of this chapter.
B. The determination of the Secretary upon the application for waiver shall be in writing, and mailed to the applicant within 60 days of the date the application for the waiver is received by the Department.
C. If granted, the waiver may remain in effect for the term of the license and may be renewed upon application of the licensee when the license is renewed.
