Rule 761-115.20 - Abandonment or removal of utility facilities

(1) Notice to department. Within 90 days after the abandonment or removal of all or a portion of an existing utility facility that occupies the primary highway right-of-way, the utility owner shall submit a written notice of abandonment or removal to the department. The notice shall include:

a. Type of facility.

b. Location of the utility facility by route, county, section, township, range, milepost and highway stationing, where these references exist.

c. Name of the original utility owner if different than the current owner.

d. Original utility permit number and date of approval, if known.
