Rule 641-154.2 - Health care practitioner certification-duties and prohibitions(1) Prior to a patient's submission of an application for a medical cannabidiol registration card pursuant to this rule, a health care practitioner shall follow all provisions of Iowa Code section 124E.3, this chapter and requests from the department for more information. a. The written documentation required by Iowa Code section 124E.3(1)"a" shall be submitted on the application form at the department's website.b. Explanatory information pursuant to Iowa Code section 124E.3(1)"b" is located at the department's website.(2) A health care practitioner may make a written request to the department to rescind a written certification the practitioner previously provided, based on reasons deemed appropriate by the health care practitioner.(3) Health care practitioner prohibitions. A health care practitioner shall not: a. Accept, solicit, or offer any form of remuneration from or to any individual, including but not limited to a patient, a primary caregiver, or an employee, investor, or owner of a manufacturer or dispensary for the purposes of: (1) Certifying a patient's condition, other than accepting a fee for a patient consultation to determine if the patient should be issued a certification under Iowa Code chapter 124E.(2) Certifying an individual as a primary caregiver, other than accepting a fee for a consultation to determine if the individual is a necessary caretaker taking responsibility for managing the well-being of the patient with respect to the use of medical cannabidiol.b. Advertise the certification of patients as one of the health care practitioner's services.c. Certify a qualifying debilitating medical condition for a patient who is the health care practitioner or a family or household member of the health care practitioner.d. Be designated to act as a primary caregiver for a patient for whom the health care practitioner has certified a qualifying debilitating medical condition.e.
