Section 760 IAC 1-38.1-5.2 - "Custodial parent" defined

Sec. 5.2.

As used in this rule, "custodial parent" means:

(1) the parent awarded custody of a child for more than one-half (1/2) of the calendar year by a court decree; or

(2) in the absence of a court decree, the parent with whom the child resides more than one-half (1/2) of the calendar year without regard to any temporary visitation.
